To ensure accuracy in ordering, please include the following information when placing your order:
1. Customer purchase order number
2. Customer shipping and billing address

Pricing

The current BOSS Price List supersedes all previous price lists. All prices are subject to change without notice. The price in effect at the time an order is placed and accepted will prevail. Prices in any price list are for one unit, unless otherwise noted.

Shipping & Handling

All prices are F.O.B. shipping point, prepaid and added to the invoice, using the carrier of our choosing, currently FedEx. Any carrier requested other than FedEx would require the freight expense be billed to the customer or 3rd party account number. Customers wishing to bill their FedEx charges to their own or 3rd party FedEx account may do so when placing their order. BOSS reserves the right to charge non-carrier related handling charges to the invoice as needed.

Acceptance

All orders are subject to approval and acceptance by BOSS. BOSS reserves the right to refuse orders, suspend orders and/or cancel unfilled orders when credit conditions of a customer warrant such actions.

Payment Terms

Unless otherwise stated, all invoices are due Net 30 days from the date of the invoice. A delinquency charge of 1.5% may be charged on all overdue balances. All international invoices shall be prepaid unless other arrangements are agreed to by BOSS. BOSS may, at its discretion, place any account that is past due on prepay status or refuse shipment entirely; until past due invoices are paid. New customers without established credit terms with BOSS may be required to prepay their initial order amount in part or in full, as well as future orders until a credit history has been established. BOSS may require a credit application to be completed including supplier references, and reserves the right to request a business credit report from one of the major credit bureaus.

Return Goods Policy

To return an item(s) that was purchased directly from BOSS, please contact customer service at the number above and request a Return Goods Authorization. If an item was purchased from a BOSS Distributor, please contact that Distributor for an RGA. Products returned without an RGA number will be returned to the shipper. All returns must be shipped prepaid and insured to:

Acceptance of returned goods should not be interpreted as authorization of credit. BOSS reserves the right to hold or deny credit for returned items until evaluated for credit eligibility.

Non-Sterile Product is only eligible for credit returns if unused, unsterilized, and intact in its original BOSS packaging when it arrives at BOSS.

Sterile Product is only eligible for credit returns if unopened, undamaged, unexpired with all labeling intact and legible. BOSS will not exchange expired products for new products.

BOSS reserves the right to deduct restocking fees from the credit amount based on the following return conditions:
1. Item(s) received at BOSS within 30 days of invoice date will not be charged restocking fees.
2. Item(s) received at BOSS between 31 and 60 days of invoice date may be charged a 15% restocking fee.
3. Item(s) received at BOSS between 61 and 90 days of invoice date may be charged a 25% restocking fee.
4. Item(s) received at BOSS after 91 days past invoice date are NOT RETURNABLE for credit.

Non-returnable items are those that are returned after more than 90 days from the date of invoice, instruments that have been used or sterilized, sterile products that have been opened or expired, and custom or modified instruments (includes custom etching).

Freight and handling charges are not subject to credit, therefore remain due and payable according to the previously noted payment terms.

WARRANTY

All BOSS instruments are guaranteed to be free from defects in materials and workmanship “FOR THE LIFE OF THE INSTRUMENT” when used in the manner for which it was designed and intended. Any instrument found to have a manufacturing defect shall, at BOSS’ discretion, be repaired or replaced free of charge.

THE WARRANTY CONTAINED IN THIS PARAGRAPH, AS LIMITED HEREIN, IS THE ONLY WARRANTY EXTENDED BY BOSS IN CONNECTION WITH ANY SALE BY IT AND IS EXTENDED TO CUSTOMER ONLY AND NOT TO ANY SUCCESSIVE BUYERS, USERS, THIRD PARTIES OR EMPLOYEES AND IS IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

The repair, alteration, or modification of any product by persons not authorized by BOSS INSTRUMENTS, LTD. and/or products subjected to physical or chemical abuse shall immediately terminate this warranty.

Warranty Exclusions

A. This warranty shall not cover conditions or defects due to customers’ improper care or use of the instruments including but not limited to customers:

  1. Negligence
  2. Improper use
  3. Improper cleaning and handling
  4. Absence of or insufficient lubrication of instruments
  5. Unauthorized repair work
  6. Caustic or abrasive cleaners

B. Damages due to ordinary use, wear, and tear of the Product.

Remedies

To the extent not covered by insurance, BOSS’s obligations hereunder upon breach of warranty or other provision shall be limited, to the repair or replacement of goods or the crediting to customer of an amount not to exceed the purchase price of the goods. If notice of a breach of warranty is given by customer, seller shall only be obligated to repair, replace or credit the purchase price for goods which examination by BOSS or its representatives shall disclose to have been defective under ordinary and normal use. Written notice of such defect shall be given by customer to BOSS at BOSS’s plant within thirty (30) days after such defects appear. In no event shall BOSS have any liability whatsoever for payment of any consequential, incidental, indirect, special or tort damages of any kind, including, but not limited to, any loss of profits. No allowance shall be made for any expenses incurred by customer in repairing defective parts or supplying any missing parts, except on the written consent of BOSS in any case, where BOSS agrees to replace or repair a defective part, customer shall have the responsibility and bear the cost for and related to procuring and providing all necessary dismantling, reassembling and handling facilities in connection therewith.

This remedy supplements the insurance coverage provided by BOSS.
